Terms of Service

InstantBallpark provides software that lets service businesses create, publish, share, and embed ballpark estimators; collect project information; and receive leads. InstantBallpark is software, not the contractor or other service provider performing the underlying work.

Estimates generated through InstantBallpark are preliminary ballpark estimates only. They are not binding quotes, contracts, guarantees, or final prices.

The service business controls its estimator configuration and pricing rules and remains responsible for its final quote and pricing. Actual pricing may change after inspection, scope review, site conditions, measurements, labor or material changes, or additional information.

Businesses using InstantBallpark are responsible for configuring their estimators, pricing and rules, reviewing leads, communicating with customers, providing final quotes, performing their services, and meeting any applicable licensing or legal requirements. InstantBallpark does not perform contractor work.

You agree to provide accurate account information, keep your credentials secure, and remain responsible for activity under your account. You may not use the service in an unauthorized or abusive way.

InstantBallpark subscriptions are billed through Stripe on a recurring monthly basis. The price of a new subscription is the price shown at the time you subscribe.

Price lock for existing subscribers. The monthly price you pay when your subscription first starts is your "signup price." As long as your subscription stays active, we will not raise your signup price for the plan you are on.

What "active" means. Your subscription stays active as long as it keeps renewing and is not canceled or ended. If a payment fails, you have 14 days from the date of the failed payment to update your payment method and pay the amount due. Your price lock continues during those 14 days. If the payment is still not made after 14 days, your subscription may end and your price lock ends with it.

New subscriptions. We may change the price for new subscriptions at any time. Those changes do not affect existing subscribers.

New plans. Your price lock covers the plan you are on. If we offer new or different plans in the future, they will be priced separately. If you choose to switch to a different plan, that plan's price at the time you switch will apply.

Change of ownership. If your business, or your InstantBallpark account, is transferred to a new owner, the price lock carries over to the new owner, as long as the subscription stays active without a break.

If your subscription ends. If your subscription is canceled or ends, your price lock ends too. If you subscribe again later, you will pay the price for new subscriptions at that time.

Taxes. Your signup price does not include taxes or other charges required by law. Those may be added, or may change, as the law requires.

You can manage or cancel your subscription through the billing portal. Cancellation normally takes effect at the end of the current billing period, and access remains available through that paid period where applicable. We do not promise refunds unless a separate written refund policy says otherwise.

Ending a subscription may stop public estimator functionality. Dashboard and historical lead information are not stated to be immediately deleted, but we do not promise permanent retention.

You may not use InstantBallpark for illegal activity, fraud, malicious code, attempts to disrupt the service, unauthorized access, abusive use, or to collect information unlawfully.

Businesses and estimator users retain their appropriate rights in the text, pricing configuration, project answers, photos, and other content they provide. They grant InstantBallpark the limited rights needed to host, process, store, and present that content in order to operate the service.

The InstantBallpark software, brand, design, and related materials remain the property of their applicable owner. These Terms do not grant you ownership of them.

InstantBallpark relies on third-party providers, including payment, hosting, storage, and email infrastructure providers. The service may occasionally be unavailable because of maintenance, failures, third-party providers, or circumstances outside our reasonable control. We do not guarantee uninterrupted availability.

InstantBallpark is provided on an “as available” basis. To the extent permitted by law, we disclaim warranties not expressly stated in these Terms. We are not responsible for a service business's pricing, estimates, communications, services, or disputes with its customers. Nothing in these Terms limits liability where the law does not allow it to be limited.

Governing law and venue: Lakewood TWP, NJ.

We may update these Terms as the service changes and will update the Last updated date when we do. We will not use an update to these Terms to raise the price of an active subscription above its signup price. Questions about these Terms can be sent to legal@instantballpark.com.
