Instant Ballpark Partner Program Terms

Last updated: October 14, 2026

These Partner Program Terms ("Partner Terms") are between you and K Group Web Solutions LLC, which operates Instant Ballpark ("we," "us"). By checking "I agree" when you apply at instantballpark.com/partners, you accept these Partner Terms. Our Terms of Service at instantballpark.com/terms also apply to your use of Instant Ballpark.

1. Eligibility and approval

  1. Applying. You apply by submitting the form at instantballpark.com/partners.
  2. Approval is our choice. We review every application by hand. Approval is at our sole discretion, and we may decline any application without giving a reason.
  3. Accurate information. You agree that the information you give us is accurate, and you will keep it up to date.
  4. Your referral link. After we approve you, we will send you your own referral link. You become an active partner once you are approved. Applying alone does not make you a partner.

2. How referrals are credited

  1. Referral link. A referral is credited when a new customer visits instantballpark.com through your referral link and signs up for an Instant Ballpark account within 90 days of that visit, in the same browser.
  2. After approval only. We credit only signups that happen after you are approved. Signups made before your approval are not credited, even if they came through your link.
  3. First touch wins. If a customer visited through more than one partner's link, the first partner link they used gets the credit. A later link does not replace it.
  4. No credit for existing customers or contacts. We do not credit customers who already had an Instant Ballpark account, or businesses that were already in our sales pipeline (for example, ones we had already contacted or were already talking to) before they used your link.
  5. Staying linked. A credited client stays linked to you for their first 12 months, counted from their first paid invoice.
  6. Tracking limits. Credit depends on our tracking, which uses a browser cookie. If the customer clears cookies, uses a different browser or device, or blocks cookies, we may not be able to credit the referral.
  7. Our records decide. Our records decide who gets credit for a referral, and they decide any dispute.

3. Partner conduct and allowed claims

  1. Describe the product as we do. You may describe Instant Ballpark only as it is described on instantballpark.com. You may say:
    • Homeowners answer a few questions and see a rough price range based on the contractor's own numbers.
    • The contractor gets the homeowner's contact details, plus photos when the homeowner adds them.
    • It's free to build and preview.
    • It's $99/mo to publish for the first 100 customers, locked in for as long as they stay subscribed.
  2. You may not:
    • call the price "forever," or promise any price without the "as long as they stay subscribed" condition;
    • call the price ranges quotes, bids, or final prices;
    • say Instant Ballpark uses AI to set prices;
    • claim integrations (for example, CRM, Zapier, or analytics integrations) that we don't list on our website;
    • promise or guarantee any number of leads, jobs, sales, or revenue;
    • send spam or unsolicited bulk messages, or contact people in a way that breaks anti-spam or privacy laws;
    • bid on "Instant Ballpark," "InstantBallpark," or similar terms or misspellings in paid search or other ads;
    • pose as Instant Ballpark or as our employee, or suggest you speak for us; or
    • offer discounts, free months, credits, or other deals we haven't approved in writing.
  3. Disclose the relationship. When you recommend Instant Ballpark, you will make clear that you may earn a commission.
  4. Breaking these rules. If you break this section, we may withhold commission on the affected referrals and end your participation under section 5.

4. Commissions and Payouts

Commissions and Payouts

  1. Commission. You earn 30% of the subscription fees each referred client actually pays Instant Ballpark during that client's first 12 months, counted from the date of their first paid invoice. That's before taxes and after refunds, credits and chargebacks. Payments after those 12 months earn no commission. Free months, discounted amounts we don't collect, and unpaid invoices earn no commission.
  2. Hold period. A commission becomes payable 30 days after the client's payment clears.
  3. Payout timing. Payable commissions are paid once a month, on the 15th. If the 15th falls on a weekend, a Jewish holiday or a US federal holiday, payment goes out the next business day.
  4. Minimum. We pay once your payable balance reaches $50. Smaller balances carry over to the next month.
  5. Refunds after payout. If a payment we already paid commission on is later refunded or charged back, we take that commission out of your future payouts.
  6. Payment method and tax forms. Payouts are made by ACH bank transfer. Before your first payout, you must give us a completed IRS Form W-9 and your bank details through a secure channel. We'll issue a Form 1099 where the law requires it.
  7. Exclusions. We pay no commission on your own account, on accounts you own or control, or on referrals that break these terms.
  8. Records. Commission is calculated from our billing records, which decide any dispute. You can ask for a statement of your earned and paid commission at any time.

5. Term and termination

  1. Either side can end it. You or we may end your participation at any time, for any reason, with written notice. Email is enough (ours: legal@instantballpark.com).
  2. When it ends. Your referral link stops crediting new signups when your participation ends. You keep earning commission on clients you referred before that date until each client's 12-month window ends, except as stated in section 5.4.
  3. Payouts continue. Commission earned within a client's 12-month window, including amounts in the 30-day hold, is paid under section 4, including the $50 minimum and the W-9 requirement.
  4. Breach. If you break these Partner Terms, we may end your participation right away. Commissions stop, and any unpaid commission tied to the breach is forfeited.

6. Independent contractor

  1. You are an independent contractor. Nothing in these Partner Terms creates an employment, agency, partnership, joint venture, or franchise relationship.
  2. You can't make promises or sign agreements on our behalf.
  3. The program is not exclusive. You may promote other products, and we may work with other partners, including in your area or industry.
  4. You are responsible for your own taxes, costs, and expenses.

7. Changes to these Partner Terms

  1. We may change these Partner Terms. We will email you notice of a change before it takes effect and update the "Last updated" date on this page.
  2. A change never takes away commission you have already earned.
  3. If you don't agree with a change, you may end your participation under section 5. If you keep promoting Instant Ballpark after the change takes effect, you accept it.

8. Disclaimers, liability, and governing law

  1. No guarantees. The partner program and Instant Ballpark are provided on an "as available" basis. To the extent permitted by law, we disclaim warranties not expressly stated in these Partner Terms. We don't guarantee any amount of commission.
  2. Liability. To the extent permitted by law, we are not liable for indirect or lost-profit damages arising from the partner program. Nothing in these Partner Terms limits liability where the law does not allow it to be limited.
  3. Governing law. Governing law and venue: Lakewood TWP, NJ.
  4. Contact. Questions about these Partner Terms: legal@instantballpark.com. Operator: K Group Web Solutions LLC.
